Homosexual coup d’état in the Kenyan Judiciary

Friday the 13th in urban legends and modern superstitions is viewed by many as a day in which bad luck reigns supreme. Indeed, a horror movie by that name has no less than 12 sequels all the way to 13! On that infamous date just over one week ago, the Kenyan Judicial Service Commission (JSC) chaired by Prof Christine Mango and starring the controversial advocate Ahmednasir Abdullahi among others, unleashed on Kenya perhaps the most radical left-leaning liberal advocate the country has ever seen as nominee for Chief Justice (CJ).

After a grueling two weeks of public interviews of 10 finalists, the JSC nominated civil society activists Dr Willy Mutunga and Ms Nancy Baraza for the positions of CJ and deputy CJ respectively. Their names were forwarded the same day to President Kibaki and PM Raila for “consultations” and appointment via parliamentary approval. Thereafter, an intriguing media storm began.

I want to state clearly from the onset that despite an overwhelming campaign by leading personalities and mainstream media commentators praising the suitability of the two to head our Judiciary, there are compelling reasons to believe that Kenyans are being deluded big time into accepting individuals who will ultimately prove fatal for our vulnerable social fabric and moral wellbeing as a nation. Notwithstanding their remarkable credentials and record advocating for greater democracy in Kenya over the last three decades, I strongly believe the pair has over the years embraced despicable western ideologies that present a clear and immediate danger to our society. Allow me to explain.

There’s now sufficient public evidence from the past week’s media storm to conclude that Mutunga and Baraza sold their consciences a long time ago to the global Homosexual movement. In numerous forums and presentations in the so-called “Human Rights” conferences, the two have made unambiguous statements that indicate their strong support for the legitimization of homosexual behaviour in Kenya that would open the way for the introduction of same-sex marriage in the country.

Its instructive to note that on 16th May, Lawyer Harrison Kinyanjui while filing a petition in the High Court challenging the nomination of the two stated in his affidavit that: “The two nominees have been openly supporting homosexuality. Dr Mutunga facilitated the incorporation of Kenya Gay and Lesbian Trust (KEGALE) dated October 31, 2006, whose objective was to engage in activism for the abolition of legal and extra legal forms of discrimination by same gender loving people.” Mr Kinyanjui questioned whether the JSC interviewed the two nominees over the same issue.

They were recorded at a CKRC meeting back in 2002 when Yash Pal Ghai (another apologist for homosexuality) was leading the constitutional review team and where Ms Baraza was also a Commissioner.

I’ve no doubts that if their appointments are approved by Parliament, it would virtually be a coup d’état in the Kenyan Judiciary as far as radical redefinition of homosexuality and our traditional family set-ups are concerned.

Legitimizing homosexuality and same-sex marriage

I predict that in the next two years, the two will attempt to gerrymander around our constitution to make rulings declaring section 162-165 of our penal code “unconstitutional” and “oppressive” to the so-called sexual “minorities”. This perversion will be done in the guise of promoting “equality”, “tolerance” and “diversity” in our society, and with great support from western powers. The earth-shaking ruling will probably be preceded by a well-choreographed lawsuit by the Gay & Lesbian Coalition of Kenya (GALCK) or some other homosexual outfit. They will claim “discrimination” on the grounds of sexual orientation and will be requesting a supreme court interpretation of the Bill of Rights. This is the game plan by the homosexual lobbies in Kenya and the nomination of Mutunga as CJ would not have come at a better time for these groups.

Let’s all be clear about one thing: Nature discriminates against homosexuality. The global taboo against homosexuality running back thousand of years is rooted in natural law – for nature (or God as author of nature) designed the anatomy and physiology of human beings in such a way that sex between men and women is sex “according to nature.” Sex between men and men or between women and women, though it can be accomplished in an unnatural manner, doesn’t seem to be what God had in mind. Finally, homosexuality has never been scientifically proven to have any genetic causes despite many attempts by western gay lobbies to falsify research into the existence of a so-called “gay gene”.

Same-sex arrangements can never be “equal” to the God-ordained institutions of marriage and family. They cannot produce children by themselves. Homosexual partners cannot acquire a child without involving heterosexual procreation in some way. There’s no doubt that society should always put the welfare of children first by favoring natural parenting (mother and father) over an atrocious experimental version (father and male lover) that models perversion to innocent children in their own home.

Dr Willy Mutunga was a strong campaigner for greater democratic space in the 1990s when former President Moi and KANU were riding roughshod over the country. To many people, he remains an icon of patriotism and nationalism. Ms Nancy Baraza also has an enviable record of civil society work standing up for human and women rights over the last three decades, especially at the FIDA.

However, this history does not give them the license to betray their motherland by foisting on the Kenyan society ideologies and values that are diametrically opposed to our moral and healthy wellbeing. Homosexuality remains in the eyes of many, an intrinsically disordered sexual behaviour and an abomination to our cultures and norms. Any attempt to impose this sick behaviour on Kenyans through judicial activism and legislation from the bench by Mutunga and Baraza should be regarded by all moral and right-thinking Kenyans as surely, a virtual act of treason due to its destructive consequences on the nation.

This is not idle talk. Historians have conclusively established that one of the major factors that led to the decline of once-great ancient empires was the acceptance and full embrace of the homosexual lifestyle by those empires. The great Roman empire crumbled and weakened under this destructive behaviour. Years of embracing the vice by Roman noblemen to levels of absurdity, considerably weakened the overall preparedness of the Roman state against potential threats.

Looking at the United States of America especially under President Obama, one can clearly tell that this nation is on the decline as a result of this moral decadence and so-called “liberal” policies that allow “civil unions” between homosexuals. To save Kenya from this future ignominy, Parliament must reject the nomination of Dr Willy Mutunga and Nancy Baraza. The two surely cannot be the only ones who can reform our Judiciary.

    Hello,
    I do not agre with your article at all but first I add I am not gay and I am a christian. From a christian perspective, homosexuality is wrong but here we are talking about holding a public office not being a priest. Our state is a secular one. Secondly, in their positions, they cannot impose laws on Kenyans, they can try to influence but I believe there are processes to be followed.
    I believe getting out of the religious intolerance and so called nature – which is not true, animals have been found gay, gay people should not be discriminated because of their sexual orientation. Jesus told the people who wanted to stone a prostitute let him who has not sinned be the first to throw a stone. And there isn’t one sin that is greater than others.
    Thirdly, I think for most gay people, it is a confusing state to be, many of them end up depressed and even commiting suicide as they struggle with who they are and who society expects them to be. What would you do if your son or daughter tells you they are gay? Do you kill them? No you try and understand why in a loving caring way – I hope. And by the way, a lot of research has gone into understaing gay people but no one can tell really why they are born the way they are. Which is why its unfair to discriminate them and they never asked to be born gay. I do not mind them getting married but I put limits on them getting or adopting children as they will be traumatized in life. So let us have a little tolerance, read and research and know what makes these people the way they are, can they change and how can we motivate them to change and certainly not by gay bashing. After all don’t we have murderers and rapists, super corrupt politicians walking freely?Who are worse?

    Welcome to this blog and to this intriguing debate.

    Reading your comments, am astounded on where to begin in addressing the many fallacies that you have postulated. In a way, am like the mosquito overflying a nudist camp and wondering in a bemused manner: Where should I begin? :-) The issues you’ve raised are profound and actually commonly repeated as propaganda by supporters of homosexuality. Am afraid I’m compelled to expose their weak points sufficiently in several posted comments to follow. So bear with me.

    Because you’ve said you are a Christian, I will tailor my responses to address each point you’ve raised from a biblical perspective. You began by saying:
    “homosexuality is wrong but here we are talking about holding a public office not being a priest. Our state is a secular one.”

    My answer – God’s moral code as articulated in the Old & New Testament in regards homosexuality has not changed and it applies to every human being. It is described as detestable in the sight of the Almighty, or an abomination if you like (refer to Leviticus 18:22, 20:33 & Genesis Chap 19). The latter is on Sodom & Gomorrah whose destruction by God himself was an actual historical event as described in the bible.

    The Apostle Peter also references this destruction in 2 Peter 2:6 where he says – “they were made as an example to those who would live ungodly thereafter.” Clearly, the Sodom story was not to be understood as a parable or a fable.

    Paul once again in Romans 1, especially from verse 18 talks of people who engage in this perversion as having a depraved mind, and they will ultimately face God’s wrath. Now, for us to have a CJ who believes that engaging in homosexuality is perfectly normal and that we should legitimise it, is a big problem.

    Our new constitution expects the position of CJ to be held by a person of high moral probity and standing in society. Just like Caesar’s wife, the CJ must be beyond reproach. You cannot divorce morality from Justice and the holder of that office should have been interrogated on his moral and family values.

    I agree that the state is secular in its civic obligations but its moral grounding is from God. After all, our new constitution has a preamble that acknowledges God as the supreme guiding authority in our affairs as a nation. So inevitably, God and his opinion will feature prominently in moral questions that affect the way we live and govern ourselves as Kenyans.

    Now this is a classic! You are stating here that because some homosexual behavior has been observed in animals, then its ok for human beings to emulate the same. Let me first clarify that all sorts of aberrations do occur in nature including various deformities in human beings.

    These are exceptions not the rule, and all normal people recognize this with compassion not celebration. And even in the animal kingdom, homosexual behavior is an oddity and not the norm.

    In any case, human beings are moral beings who don’t get their moral values based on animal behavior but from their Creator. We are radically different and not driven by mere instinct in many of our decisions.

    Lets for a moment take your astonishing “nature” logic to its conclusion – Many animals routinely eat their young after giving birth – should we now emulate them?

    It’s also common in rural Kenyan farms to observe the males of livestock such as cattle, goats, rabbits and hens mating with their own “mothers”, “sisters” and “daughters” – incest if you will in human terms. Should we also emulate them?

    Animals also move around while naked and they can mate in public without any inhibitions – why can’t we also emulate them?

    That is true to a certain extent although the bible is clear that there are some sins that are particularly detestable to God such as blasphemy. Indeed blasphemy against the Holy Spirit is said to be an unforgivable sin! (Matthew 12:31-32). So clearly, not all sins are equal or the same. Homosexuality happens to be one of those that are described as an abomination.

    But more on this: Why promote and defend this particular sin anyway? Well, I’ve not seen people forming coalitions lobbying for the legitimization of adultery in any society. Corruption and theft of public money has also been with Kenyans since the 1960s. I’ve not seen anyone picketing for the “right” to engage in the same.

    If you are careful to read the bible, you will notice that 1 Corinthians 13:6 says that true love does not rejoice when people are engaged in wrongdoing. In fact, people who support homosexuality in the guise of “loving” its practitioners can be described as actually hating them because they are encouraging them further into iniquity.

    Beware also of Paul’s warning in Romans 1:32 regarding people who approve of evil: “Although they know God’s righteous decree that those who do such things deserve death, they not only continue to do these very things but also approve of those who practice them.” True biblical Christianity will never compromise its moral teachings to comply with popular/emerging culture because God’s decrees on morality never change.

    Yes, am aware that homosexual people who are conflicted about their condition go through lots of anguish due to social stigma. Much as am sympathetic, this stigma is not necessarily bad because it’s the one that compels wrong doers in society to change.

    The solution is certainly not to celebrate and accept their wrong behavior but to point them in the right direction. Exodus International with thousands of ex-gay members has proved that the condition is changeable and not permanent, as its promoters in the west would wish to falsely claim. As a Christian, you may also be aware of gospel singer Donnie MCcLurkin who abandoned his homosexual lifestyle with God’s help.

    I’ve always wondered, why do the supporters of homosexuality always attempt to use this weak example to shut down people like me who consistently stand up against this dangerous behavior? The answer is very simple.

    Of course I would not kill them, and neither would I support their wrong lifestyle choices. I would still maintain that they are wrong to engage in the vice, enlighten them of the dangers (which includes a raging epidemic of diseases and risk of jail time in Kenya) and help them seek to be freed from their condition.

    For the ones who would refuse such help and insist on forcing the same on our families and society, I maintain that the law should take its course and punish the practitioners – 14 years jail time under the Penal Code sections 162-165.

    Again, not true. No one is “born gay”. Despite years of trying to falsify research findings into its genetic causes, homosexual lobbies in the west have failed to identify a “gay gene” or any genetic origins of the behavior. Remember, one is defined as a homosexual person because of their behavior, which remains changeable. Its not immutable or comparable to skin color (race) as President Obama and others have falsely claimed.

    Now this is very strange for someone who claims to be a Christian! Haven’t you read in Genesis 5:2 that God created humans as male and female? Jesus referred to the same verses in Mat 19:4-5 when he said “’For this reason a man will leave his father and mother and be united to his wife, and the two will become one flesh”. Jesus was surely not anticipating that Mr Steve and Sir James would one day become one flesh!

    My answer – if you’ve bothered to go through my blog, you will clearly see that I’ve done extensive research over the years to understand the causes of homosexuality, its solutions, and its consequences for individuals and society as a whole. Telling the truth to someone who is practicing the behaviour is not “gay bashing” or “hating”, as practitioners love retorting – it is the beginning of positive change. To paraphrase Jesus, the truth will set them free, if they are willing to be freed.

    As for the numerous criminals that you’ve mentioned, the fact that we have them in society doesn’t give them the license to do what they do. Unless you are suggesting that we abandon our condemnation and embrace their practices, since “they are walking freely.” Kenyans of course know in countries where the rule of law exists, these “heroes” of Kenya would have long been jailed. That’s why we want to reform our institutions such as the Judiciary like yesterday, but not by adding more rot to the same.

    You know, I really get tired of people who call others “intolerant” for pointing out that the promotion of homosexuality is immoral and against nature and God’s will. For you as a Christian, the fact that you call others “intolerant” for simply pointing out God’s verdict on homosexuality tells me that you are the one with an argument against God himself and his decrees. I think you may need to re-examine your faith and how you view his sovereignty in your own life and the world.

    I simply cannot pretend that I can be more tolerant than God himself on this issue.

    Thanks for the link. Certainly the homosexual lifestyle remains extremely dangerous to its practitioners despite its adoption and false corruption of the English word “gay”.

    Homosexuality is now widely accepted as the biggest driving force in the spread of the AIDS epidemic across the world. In Kenya, the National AIDS Council will tell you that 25% of all new HIV infections in the country are occurring in homosexual men – a group that is less than 2% of the adult male population. What now cracks me up is that the gay lobbies in the country have somehow convinced this council that legitimisation of homosexuality will in some mysterious ways stop the spread of HIV among its practitioners. How, somebody please enlighten me, will this happen?

    I believe the council, like many other corrupt institutions in the country, simply sold their consciences to western organisations hell-bent on promoting homosexuality across the world, with a promise to help legitimise the same in Kenya under the stupid guise of fighting AIDS. I’ll give them some free advise: To stem the wave of HIV infections in homosexual groups, the first solution is for its practitioners to abandon the vice altogether.

    I dont want to get into too much rhetoric here but must say I partly agree with Kate, we are a secular state and religious values are diverse and can be contradicting….

    I think it is one’s constitutional right to choose who to sleep with as long as they are both consenting adults… to legalise or to criminalise homosexuality – the big debate wooo hooo everyone has an opinion and the debate will go on….truth is, in this debate we cannot impose religious beliefs on matters that affect a whole nation! is it in the constitution for example that one must be baptised or saved? I think you need to identify your audience because not all of us Kenyans are christians and then not all kenyan christians hold the same homophobic views you do…

    Kenya is not a christian state – Kenya is a state and everyone holds their own view…you have reflected yours – kudos..let others hold their views too.

    This country is big for everyone.

    Now,

    Regarding the issue of the spread of HIV and AIDS – oh come on lets stop being naive…high infections among MSM is primarily because most individuals are persecuted when they try to access health care and the basic preventive services available to “everyone else”….

    let us please stick to the facts, HIV is spread when infected fluids are exchanged i.e. blood, sexual fluids – thats not a gay issue but rather it involves ALL SEXUALLY ACTIVE INDIVIDUALS.

    Anyone not able to access preventive messaging, services, care and treatment to curb the spread can be considered a vulnerable group and really, HIV and AIDS is not going to go if certain groups are excluded! Deal with it.

    If homosexuals as you recommend “abandon the vice” (which is ludicrous because Blake, nobody called your personal dating habits a vice and I guess nobody with common sense would) and hypothetically “straighten out” would this stop the virus from crossing over to the new partners you seem to be approving of? So what is the issue here?

    Oh come on let us be a little more objective in thinking!

    Homosexuality and hard drugs like cocaine, heroine, marijuana, meth, etc. should remain illegal in Kenya even if it’s between 2 or more consenting adults. This is because they wreck havoc to the health, productivity, healthcare budgets, and economy of any country, especially poor ones like Kenya.

    HIV is very expensive to treat and you’re much more likely to get it from anal than from vaginal sex. Before attacking me, please read The Health Risks of Gay Sex by John R. Diggs, Jr., M.D.

    When I was a kid in the 80s, gay used to mean happy. In the Peter and Jane story books, the author would write, “Jane is gay” meaning “Jane is happy”.

    Welcome to the debate.

    Before I tear apart your woefully shallow arguments, I would like to inform you that this blog was not set-up to talk to Christians only but to every Kenyan despite what they’ve chosen to worship. I responded to Kate by enlightening her on the proper Christian perspective to the issue only because she claimed to be a Christian.

    Nonetheless, the issue of homosexuality cuts across all cultures, religions, geographical locations and history. Indeed, it is also a biological issue touching on our most basic understanding of what it means to be male or female. Across all these spectrums, the overwhelming majority view has always held that homosexual behaviour in human beings is an aberration, a perversion and one of the most depraved practices the human mind has ever conceived. And this for many good reasons evident to everyone except the most deluded, or perhaps the most evil among us.

    HIV/AIDS statistics obtained from the shockingly promiscuous MSM groups you appear to sympathise with, remain undisputed in the medical world. If you bothered to read down the webpage freely provided above by “Kenyan Dude” you would appreciate the destructive nature of the lifestyle some misguided fellows in the west had the nerve to call “gay” for propaganda reasons.

    Overwhelming data strongly indicates that men who have sex with men are almost 50 times at risk of HIV infection compared to normal men who only have sex with women. The HIV virus must be having an easier entry through tissue tearing that occurs in the anal regions of these men. This appears to be the only rational explanation for these high infection rates even in gay-affirming countries such as the Netherlands (is that why its name starts with “nether”? :-) . Clearly the anus was not meant for that kind of activity. The vagina on the other is wonderfully designed for sexual activity with natural lubrication that reduces dramatically the chances of severe wear and tear frequently encountered by homosexual practitioners.

    If thats not a good reason to abandon homosexuality, tell me what is.

    And these findings are independently attested by many reputable researchers – please refer to an earlier post on Homosexuality and AIDS for more details.

    Just a few questions for you Soni: How on earth are HIV positive homosexual people in Kenya denied ARV treatments as compared to other normal Kenyans? Do they have a stamp on their foreheads written “Homosexual”? Do Kenyans go to hospital and fill out forms indicating how they like doing their sex as a condition for treatment? Do the fellows who have sex with goats or chickens ever announce their “orientation” to doctors in Kenyan hospitals in order to be treated for malaria?

    It is utter nonsense to claim here that homosexuals in Kenya do not access healthcare because of their so-called orientation. This cheap homo propaganda assumes that we are fools who can’t think. It may work for their donors in the western capitals but that crap just can’t stand rational scrutiny.
